This Private Host & Premises Agreement (“Agreement”) is entered into between Yeenova LLC dba Mahjong Academy (“Mahjong Academy”) and the individual hosting or authorizing the Event at the premises (“Host”) in connection with a private Mahjong class, instructional session, guided play session, or other event expressly organized and provided by Mahjong Academy (“Event”).
This Agreement applies only to Events organized or provided by Mahjong Academy. It does not apply to independently organized Community Hosted tables listed through HeyMahjong TableMatch.
1. Scope of Services
Mahjong Academy will provide professional Mahjong instruction and/or Event facilitation, Mahjong tile sets for use during the Event, playing mats, learning materials as applicable, and related Event support for the agreed-upon session.
Mahjong Academy provides Mahjong instruction and Event facilitation only and is not responsible for food, beverages, catering, alcohol service, or general management of the premises unless separately agreed to in writing.
Equipment Care
The Host agrees to exercise reasonable care with respect to Mahjong Academy tile sets, mats, learning materials, and other equipment brought onto the premises.
To the extent permitted by applicable law, the Host may be responsible for reasonable repair or replacement costs for Mahjong Academy equipment that is lost or damaged as a direct result of the Host’s intentional misconduct or gross negligence, or the Host’s failure to comply with the pet and animal containment requirements of this Agreement.
Ordinary wear and tear is excluded.
2. Premises Safety & Accessibility
The Host agrees to provide a reasonably clean and safe environment with adequate tables, seating, lighting, and space for the Event.
The Host agrees to use reasonable care to ensure that entrances, walkways, stairs, Event areas, and restroom access pathways are adequately lit and reasonably free from known slip, trip, or other safety hazards.
The Host agrees to notify Mahjong Academy before the Event of any known condition at the premises that could reasonably present a safety concern to participants or instructors.
The Host agrees to maintain reasonably clear access to entrances and exits and, where applicable, provide necessary gate, building, or access instructions so that emergency responders can reach the Event area without unreasonable delay.
The Host remains responsible for the premises and for maintaining any homeowners, renters, property, liability, or other insurance the Host considers appropriate.
3. Pet & Animal Containment — Required
FOR THE SAFETY AND COMFORT OF PARTICIPANTS, INSTRUCTORS, AND GUESTS, THE HOST AGREES TO SECURELY CONTAIN HOUSEHOLD PETS AND DOMESTIC ANIMALS, INCLUDING DOGS, IN A SEPARATE ENCLOSED AREA AWAY FROM THE EVENT SPACE DURING INSTRUCTOR SETUP, THE EVENT, AND TEARDOWN.
The Host is responsible for ensuring that animals do not enter the Event or equipment areas during this period.
4. Host Responsibility & Indemnification
The Host is responsible for conditions of the premises and for food, beverages, or alcohol provided or arranged by the Host or other third parties.
To the extent permitted by applicable law, the Host agrees to indemnify and hold harmless Yeenova LLC dba Mahjong Academy and its instructors, employees, contractors, and representatives from third-party claims, losses, damages, or expenses to the extent arising from the Host’s negligent or wrongful acts or omissions, unsafe conditions of the premises within the Host’s knowledge or control, Host-provided food or beverages, or the Host’s failure to comply with the pet and animal containment requirements of this Agreement.
Nothing in this Agreement requires the Host to indemnify Mahjong Academy for losses to the extent caused by Mahjong Academy’s own negligence or wrongful conduct.
5. Alcohol
Mahjong Academy does not sell, serve, furnish, or supervise alcoholic beverages as part of its Mahjong services unless expressly agreed otherwise in writing.
If alcohol is provided at the Event by the Host, venue, caterer, or another third party, that party is responsible for its provision, service, and compliance with applicable requirements.
6. Cancellation, Participation & Host Benefits
Unless otherwise stated in the Event booking, proposal, or other written agreement, private Events require a minimum of four paid participants.
Host cancellations or requests to reschedule must be submitted at least 72 hours before the scheduled Event.
Any applicable deposits, cancellation charges, refunds, or rescheduling terms will be governed by the booking terms agreed to at the time the Event is confirmed.
Any Host Rate, credit, discount, complimentary participation, or other benefit offered to the Host in connection with providing the premises will be stated in the applicable booking confirmation or Event terms.
Unless expressly stated otherwise, a Host Rate, credit, discount, or other Host benefit has no cash value and does not make the Host an employee, contractor, agent, representative, or service provider of Mahjong Academy.
7. Community Standards
Hosts and participants are expected to comply with the HeyMahjong Community Guidelines and any reasonable Event-specific requirements communicated by Mahjong Academy.
The Community Guidelines supplement this Agreement but do not replace the Host’s premises-related responsibilities under this Agreement.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles.
9. Severability
If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
10. Acknowledgment & Acceptance
BY SIGNING BELOW OR ACCEPTING THIS AGREEMENT ELECTRONICALLY, I CONFIRM THAT I AM THE PROPERTY OWNER, AUTHORIZED OCCUPANT, OR OTHER PERSON AUTHORIZED TO HOST THE EVENT AT THE PREMISES.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO ITS TERMS, INCLUDING THE PREMISES SAFETY, EQUIPMENT CARE, AND PET & ANIMAL CONTAINMENT REQUIREMENTS.
