Mahjong Academy Participant Agreement & Release of Liability

Please review this Agreement before participating in a class, instructional session, guided play session, or other activity expressly organized or provided by Yeenova LLC dba Mahjong Academy (“Mahjong Academy”).

This Agreement applies only to activities organized or provided by Mahjong Academy. It does not apply to independently organized Community Hosted tables listed through HeyMahjong TableMatch.

Important: You will be asked to accept this Agreement when completing your participant waiver. Photo and media consent is requested separately and is optional.

1. Voluntary Participation & Assumption of Risk

I voluntarily choose to participate in a Mahjong class, instructional session, guided play session, or other activity expressly organized or provided by Mahjong Academy (collectively, the “Activity”).

I understand that the Activity may take place at a private residence, club, public or community facility, commercial property, or other third-party location.

Although Mahjong is generally a low-impact activity, attendance and participation may involve ordinary and reasonably foreseeable risks associated with an in-person gathering, including entering and leaving the premises, slips, trips, falls, interaction with furniture or equipment, and conditions at the location where the Activity takes place.

I knowingly and voluntarily assume the known and reasonably foreseeable risks associated with my participation in and attendance at the Activity.

2. Release of Liability — Please Read Carefully

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I RELEASE AND DISCHARGE YEENOVA LLC DBA MAHJONG ACADEMY, ITS OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, REPRESENTATIVES, AND AGENTS, AND THE OWNER, OCCUPANT, OR HOST OF THE PREMISES AT WHICH THE ACTIVITY OCCURS (COLLECTIVELY, THE “RELEASED PARTIES”), FROM CLAIMS ARISING OUT OF OR RELATING TO MY PARTICIPATION IN OR ATTENDANCE AT THE ACTIVITY, INCLUDING CLAIMS FOR PERSONAL INJURY, ILLNESS, OR DAMAGE TO MY PERSONAL PROPERTY.

THIS RELEASE INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY TO THE EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED.

This release does not apply to gross negligence, reckless or intentional misconduct, or liability that cannot lawfully be waived.

3. Participant Responsibility

I agree to follow reasonable safety instructions provided by Mahjong Academy, its instructors, the venue, or the Host and to conduct myself in a manner that does not create an unreasonable risk of injury or property damage.

I agree to respect the premises, Mahjong Academy equipment, and the property and belongings of other participants.

I understand that I may be responsible, to the extent permitted by law, for loss, injury, or property damage caused by my own negligent, reckless, or intentional conduct.

4. Private Homes and Third-Party Venues

I understand that some Activities may take place in a private residence or other location that is not owned or controlled by Mahjong Academy.

I agree to follow reasonable house or venue rules, remain within areas made available for the Activity, and respect the privacy and property of the Host.

I will not share a private residential address, gate code, access instructions, or other nonpublic information provided in connection with the Activity with unauthorized persons.

I will not bring additional or unregistered guests to a private residence or other restricted venue without prior permission.

5. Emergency Medical Assistance

I represent that I am able to participate safely in the Activity.

If a medical emergency occurs and I am unable to act on my own behalf, I authorize Mahjong Academy personnel, the instructor, venue personnel, or Host to contact emergency services and take reasonable steps to obtain emergency assistance for me.

I understand that I am responsible for medical or emergency-service costs incurred on my behalf.

6. Community Standards

I agree to comply with the HeyMahjong Community Guidelines and reasonable Activity-specific requirements communicated by Mahjong Academy, the instructor, or the venue.

I understand that serious or repeated violations of applicable community or safety standards may result in my removal from an Activity or restriction from future HeyMahjong or Mahjong Academy activities, subject to applicable policies and law.

7. Optional Photo & Media Consent

Participation in the Activity is not conditioned upon granting photo or media permission.

When completing the participant waiver, I may separately choose whether to allow Yeenova LLC dba Mahjong Academy to photograph or record me during the Activity and use those photographs or recordings for educational, promotional, website, marketing, and social-media purposes.

If permission is granted, my name or other identifying personal information will not be published with photographs or recordings without separate permission.

Declining photo or media consent does not affect my eligibility to participate in the Activity.

8. Participants Under 18

If Mahjong Academy permits a participant under 18 to attend a particular Activity, the participant’s parent or legal guardian must review and accept this Agreement on the minor’s behalf and complete any additional consent or documentation required by Mahjong Academy before the minor participates.

By signing or accepting this Agreement on behalf of a minor, the parent or legal guardian represents that they have legal authority to provide such consent.

Nothing in this section permits a minor to participate in a service or Activity that is otherwise designated for adults only.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles.

10. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

11. Acknowledgment

I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND THAT IT CONTAINS AN ASSUMPTION OF RISK AND RELEASE OF LIABILITY AND THAT, BY ACCEPTING IT, I MAY BE GIVING UP CERTAIN LEGAL RIGHTS.

I have had the opportunity to review this Agreement before accepting it and may ask questions before participating in the Activity.
